Information About the Maryland
Register and COMAR
MARYLAND REGISTER
The Maryland Register is an official State publication published every
other week throughout the year. A cumulative index is published quarterly.
The Maryland Register is the temporary supplement to the Code of
Maryland Regulations. Any change to the text of regulations published in COMAR, whether by adoption, amendment,
repeal, or emergency action, must first be published in the Register.

CODE OF MARYLAND
REGULATIONS (COMAR)
COMAR is the official compilation of all regulations issued by agencies
of the State of Maryland. The Maryland Register is COMAR’s temporary
supplement, printing all changes to regulations as soon as they occur. At least
once annually, the changes to regulations printed in the Maryland Register are
incorporated into COMAR by means of permanent supplements.
CITATION TO COMAR
REGULATIONS
COMAR regulations are cited by title number, subtitle number, chapter
number, and regulation number. Example: COMAR 10.08.01.03 refers to Title 10,
Subtitle 08, Chapter 01, Regulation 03.
DOCUMENTS INCORPORATED
BY REFERENCE
Incorporation by reference is a legal device by which a document is made
part of COMAR simply by referring to it. While the text of an incorporated
document does not appear in COMAR, the provisions of the incorporated document
are as fully enforceable as any other COMAR regulation. Each regulation that
proposes to incorporate a document is identified in the Maryland Register by an
Editor’s Note. The Cumulative Table of COMAR Regulations Adopted, Amended or
Repealed, found online, also identifies each regulation incorporating a
document. Documents incorporated by reference are available for inspection in
various depository libraries located throughout the State and at the Division
of State Documents. These depositories are listed in the first issue of the
Maryland Register published each year. For further information, call

HOW TO RESEARCH REGULATIONS
An
Administrative History at the end of every COMAR chapter gives information
about past changes to regulations. To determine if there have been any
subsequent changes, check the ‘‘Cumulative Table of COMAR Regulations Adopted,
Amended, or Repealed’’ which is found online at http://www.dsd.state.md.us/PDF/CumulativeTable.pdf.
This table lists the regulations in numerical order, by their COMAR number,
followed by the citation to the Maryland Register in which the change occurred.
The Maryland Register serves as a temporary supplement to COMAR, and the two
publications must always be used together. A Research Guide for Maryland
Regulations is available. For further information, call 410-260-3876.

INFORMATION

CITIZEN PARTICIPATION IN
THE REGULATION-MAKING PROCESS
Maryland citizens and other interested
persons may participate in the process by which administrative regulations are
adopted, amended, or repealed, and may also initiate the process by which the
validity and applicability of regulations is determined. Listed below are some
of the ways in which citizens may participate (references are to State
Government Article (SG),
Annotated
Code of Maryland):
• By submitting data or views on proposed
regulations either orally or in writing, to the proposing agency (see
‘‘Opportunity for Public Comment’’ at the beginning of all regulations
appearing in the Proposed Action on Regulations section of the Maryland
Register). (See SG, §10-112)
• By petitioning an agency to adopt, amend,
or repeal regulations. The agency must respond to the petition. (See SG
§10-123)
• By petitioning an agency to issue a
declaratory ruling with respect to how any regulation, order, or statute
enforced by the agency applies. (SG, Title 10, Subtitle 3)
• By petitioning the circuit court for a
declaratory judgment
on
the validity of a regulation when it appears that the regulation interferes
with or impairs the legal rights or privileges of the petitioner. (SG, §10-125)
• By inspecting a certified copy of any
document filed with the Division of State Documents for publication in the
Maryland Register. (See SG, §7-213)

Maryland Documents
The Maryland Department of
Legislative Services receives copies of all publications issued by State
officers and agencies. The Department prepares and distributes, for a fee, a
list of these publications under the title ‘‘Maryland Documents’’. This list is
published monthly, and contains bibliographic information concerning regular
and special reports, bulletins, serials, periodicals, catalogues, and a variety
of other State publications. ‘‘Maryland Documents’’ also includes local
publications.

This table, previously printed in the Maryland Register lists the regulations, by COMAR title, that have been adopted, amended, or repealed in the Maryland Register since the regulations were originally published or last supplemented in the Code of Maryland Regulations (COMAR). The table is no longer printed here but may be found on the Division of State Documents website at www.dsd.state.md.us.

The table below lists proposed changes to COMAR regulations. The proposed changes are listed by their COMAR number, followed by a citation to that issue of the Maryland Register in which the proposal appeared. Errata and corrections pertaining to proposed regulations are listed, followed by “(err)” or “(corr),” respectively. Regulations referencing a document incorporated by reference are followed by “(ibr)”. None of the proposals listed in this table have been adopted. Emergency Regulations
Under State
Government Article, §10-111(b), Annotated Code of Maryland, an agency may
petition the Joint Committee on Administrative, Executive, and Legislative
Review (AELR), asking that the usual procedures for adopting regulations be set
aside because emergency conditions exist. If the Committee approves the request,
the regulations are given emergency status. Emergency status means that the
regulations become effective immediately, or at a later time specified by the
Committee. After the Committee has granted emergency status, the regulations
are published in the next available issue of the Maryland Register. The
approval of emergency status may be subject to one or more conditions,
including a time limit. During the time the emergency status is in effect, the
agency may adopt the regulations through the usual promulgation process. If the
agency chooses not to adopt the regulations, the emergency status expires when
the time limit on the emergency regulations ends. When emergency status
expires, the text of the regulations reverts to its original language.

The Secretary of Natural
Resources proposes to amend Regulation .05 under COMAR 08.02.01
General.
Statement of Purpose
The purpose of this action is to update the commercial license targets. The proposed action modifies the authorization targets to reflect the number of tidal fish license conversions since April 15, 2019. The modification is necessary to accurately reflect the number of authorizations available.
Natural Resources Article, §4-701, Annotated Code of Maryland allows a licensee to convert (downgrade) their unlimited tidal fish license (UTFL) into its individual component authorizations and requires the Department to adjust all authorizations accordingly. Licensees who downgrade their UTFL may choose which license components of the UTFL they want to retain. Downgrading a UTFL decreases the UTFL target and increases the target of each license type that is included in a UTFL (resident fishing guide (FGR); unlimited finfish harvester (FIN); crab harvester 300 pot (CB3); clam harvester (CLM); oyster harvester (OYH); oyster dredge boat (ODB); and conch, cancer crab, turtle, lobster (CCTL)). The number and type of authorizations involved in a downgrade of a UTFL provide the basis for changes to the license authorization target levels.
The proposed action decreases the UTFL number by 16 and increases the number for FGR, FIN, CB3, CLM, OYH, ODB, and CCTL by16 each. The total number of UTFL downgrades includes: 11 from the 2019/2020 license year; 0 from the 2020/2021 license year; 2 from the 2021/2022 license year; 2 from the 2022/2023 license year; and 1 from the 2023/2024 license year. The downgrades have not been captured in previous regulation proposals and are correct as of January 15, 2025.

I. Summary of Economic Impact. The Department has allocated $19.6 million to fee increases for dental rate reimbursement. Sixty-six preventative and restorative dental services codes receive an increased reimbursement rate with this action. The Department anticipates an increase in expenditures of $19.6 million while Maryland Medicaid Dental Providers will see a $19.6 million benefit from these increased rates.

Statement of Purpose
The purpose of this action is to update regulations to:
(1) Establish a mandatory dispute resolution process through the Office of Administrative Hearings to ensure that both social equity licensees and operational cannabis licenses have a fair opportunity to work through potential breaches in the agreement;
(2) Include definitions to avoid misunderstandings;
(3) Define the Social Equity Partnership Grant Program evaluation criteria; and
(4) Establish a process by which the Office will approve partnership agreements across license types.

I. The Office of Social
Equity shall evaluate grant applications on a pass or fail basis according to
the following criteria:
(1) Demonstration that
the operational cannabis licensee has capacity to support a social equity
licensee;
(2) A comprehensive
estimation of the value of services provided that assigns a value to each
element of services provided;
(3) Demonstration that
the operational cannabis licensee has been compliant with the Maryland Cannabis
Administration regulation related to:
(a) Health and safety;
(b) Diversion and theft;
and
(c) Any area material
to the proposed partnership;
(4) Attestation that
both the operational cannabis licensee and social equity licensee will have an
equal role in addressing any changes required in the partnership; and
(5) Any additional
criteria the Office of Social Equity may include to assist with the review of
each application, including but not limited to a party’s prior conduct within
the Social Equity Partnership Grant Program.
J. Requests for
Information.
(1) The Office of
Social Equity may request an applicant submit supporting documentation related
to the applicant’s efforts to establish any of the application criteria
outlined in §I of this regulation.
(2) Any information
requested by the Office of Social Equity is due within 10 business days of the
date of the request, unless otherwise noted.
(3) The Office of
Social Equity may deny an application if its request for information is not
fulfilled within 10 days.
K. To select passing
applications, the Office of Social Equity shall conduct a lottery that is
impartial, random, and in a format selected by the Office of Social Equity.
L. Application and
Award Limits.
(1) An operational
cannabis licensee without common ownership or control of another operational
cannabis licensee submitting an application:
(a) May submit only one
application per award period; and
(b) May be awarded up
to one qualifying partnership per award period.
(2) Operational
cannabis licensees who share common ownership or control submitting
applications:
(a) May collectively
submit up to two applications per award period; and
(b) May collectively be
awarded up to two qualifying partnerships per award period.
(3) A social equity
licensee may submit one application per award period.
M. Partnership
Disputes.
(1) If a cannabis
licensee engaged in a qualifying partnership claims a breach in their
qualifying partnership has occurred, the licensee shall submit a written
complaint in the manner specified by the Office of Social Equity.
(2) The Office of
Social Equity may request additional information necessary to investigate the
complaint.
(3) After reviewing the
complaint and any additional information, the Office of Social Equity may:
(a) Make a
determination about whether a breach of a partnership agreement has occurred;
or
(b) Refer the complaint to the Office of Administrative Hearings for mandatory mediation.
(4) Mediation
procedures shall be in accordance with COMAR 28.02.01.18.
(5) The Office of
Social Equity may establish written standards of conduct with which the parties
shall comply during the mediation process.
(6) The Office of
Social Equity shall disclose all written standards of conduct to the parties at
the time the matter is referred to the Office of Administrative Hearings for
mediation.
(7) A party’s failure
to abide by a written standard of conduct may result in termination of the
mediation process.
(8) If an agreement is reached by the parties as a result of mediation,
the parties shall provide a written statement outlining the agreement terms to
the Office of Social Equity.
(9) If the parties
fail to reach an agreement, the mediator shall give written notice to the
Office of Social Equity that an agreement was not reached at mediation.
(10) If the Office of
Social Equity determines that a licensee has breached its agreement, it may:
(a) Restrict, revoke,
or invalidate a partnership agreement;
(b) Require repayment
of any grant funding received by the operational cannabis licensee; or
(c) Require amendments
to the partnership agreement as determined by the terms of any mediation
agreement reached by the parties as a result of mediation before the Office of
Administrative Hearings.
(11) The Office of
Social Equity will monitor compliance of the parties with the terms of any
mediation agreement and will then make a determination about the partnership
dispute and shall notify both licensees of its determination.
N. An aggrieved party
shall exhaust all administrative remedies provided in this subtitle before
seeking review in any other forum.
O. The Office of Social
Equity may refer any suspected violation of this subtitle or Alcoholic
Beverages and Cannabis Article, Title 36, Annotated Code of Maryland to the Maryland
Cannabis Administration for further investigation.

The Board of Trustees for the Maryland State Retirement and Pension System proposes to:
(1) Amend Regulation .02 under COMAR 22.01.05 Proof of Date of Birth; and
(2) Amend Regulations .01 and .02, adopt new Regulation .03, amend and recodify existing Regulation .03 to be Regulation .04 and recodify existing Regulation .04 to be Regulation .05 under COMAR 22.01.12 Enrollment in the State System.

by the Board of Trustees for the Maryland State Retirement and Pension System
at an open meeting held on October 15, 2024, notice of which was given by
publication on the website for the Maryland State Retirement and Pension System
pursuant to General Provisions Article, §3-302(c), Annotated Code of Maryland.
Statement of Purpose
The purpose of this action is to clarify and update the provisions in COMAR 22.01.05 that address the forms of "proof of birth" that the Maryland State Retirement Agency may accept from its members, retirees, and beneficiaries. Additionally, these proposed regulations make technical and clarifying changes to COMAR 22.01.12, including:
(1) Providing the documents the Agency will need to receive if a member chooses not to participate in the Maryland State Retirement and Pension System; and
(2) Allowing for the Executive Director of the Agency to waive penalties that are imposed on a participating employer of the System for the failure to enroll a member, if the failure is satisfactorily addressed by the member's employer.

Draft Noncontrolled Prescription Drug Dispenser Data Submission
Manual
The Maryland Health
Care Commission (MHCC) has drafted the Noncontrolled Prescription Drug
Dispenser Data Submission Manual (dispenser manual) as required by COMAR
10.25.18, Health Information Exchanges: Privacy and Security of Protected
Health Information. The regulations
support the implementation of Chapter 296 (House Bill 1127), Public
Health - State Designated Exchange - Health Data Utility (2022), which
requires dispensers to submit information to the State-Designated health
information exchange (HIE) after dispensing a noncontrolled prescription drug.
The purpose of this
action is to solicit comments on the proposed draft dispenser manual which
provides technical guidance to dispensers for reporting noncontrolled
prescription drugs. The draft dispenser

Summary
Health General
Article §19-145 requires the State-Designated HIE to operate a Health Data
Utility and mandates dispensers submit noncontrolled prescription drug dispense
information to the State-Designated HIE.
The State-Designated HIE will make the information available for
purposes of treatment and care coordination of a patient, public health, and
quality improvement.
COMAR 10.25.18, Health Information Exchanges:
Privacy and Security of Protected Health Information requires MHCC to
annually develop and approve a dispenser manual for reporting noncontrolled
prescription drug information that aligns, to the extent possible, with
Maryland Prescription Drug Monitoring Program (PDMP). The manual must minimally specify the:
(a) Data that must be submitted to
the State-Designated HIE and in what format
(b) Timeframe and frequency of data
submission
(c) Electronic reporting
specifications (e.g., encryption, file layout)
(d) Process for dispensers unable to
submit data due to mechanical, electrical, or other technical failure
A multi-stakeholder
approach guided iterative development of the dispenser manual. The MHCC collected feedback on informal
drafts of the dispenser manual in summer 2024, fall 2024, and spring 2025. The final dispenser manual will be
posted on mhcc.maryland.gov.
