MARYLAND REGISTER

The Maryland Register is an official State publication published every other week throughout the year. A cumulative index is published quarterly.

The Maryland Register is the temporary supplement to the Code of Maryland Regulations. Any change to the text of regulations published in COMAR, whether by adoption, amendment, repeal, or emergency action, must first be published in the Register.

CITATION TO THE MARYLAND REGISTER

The Maryland Register is cited by volume, issue, page number, and date. Example:

19:8 Md. R. 815 817 (April 17, 1992) refers to Volume 19, Issue 8, pages 815 817 of the Maryland Register issued on April 17, 1992.

CODE OF MARYLAND REGULATIONS (COMAR)

COMAR is the official compilation of all regulations issued by agencies of the State of Maryland. The Maryland Register is COMAR s temporary supplement, printing all changes to regulations as soon as they occur. At least once annually, the changes to regulations printed in the Maryland Register are incorporated into COMAR by means of permanent supplements.

CITATION TO COMAR REGULATIONS

COMAR regulations are cited by title number, subtitle number, chapter number, and regulation number. Example: COMAR 10.08.01.03 refers to Title 10, Subtitle 08, Chapter 01, Regulation 03.

DOCUMENTS INCORPORATED BY REFERENCE

Incorporation by reference is a legal device by which a document is made part of COMAR simply by referring to it. While the text of an incorporated document does not appear in COMAR, the provisions of the incorporated document are as fully enforceable as any other COMAR regulation. Each regulation that proposes to incorporate a document is identified in the Maryland Register by an Editor s Note. The Cumulative Table of COMAR Regulations Adopted, Amended or Repealed, found online, also identifies each regulation incorporating a document. Documents incorporated by reference are available for inspection in various depository libraries located throughout the State and at the Division of State Documents. These depositories are listed in the first issue of the Maryland Register published each year. For further information, call 410-974-2486.

HOW TO RESEARCH REGULATIONS

An Administrative History at the end of every COMAR chapter gives information about past changes to regulations. To determine if there have been any subsequent changes, check the Cumulative Table of COMAR Regulations Adopted, Amended, or Repealed which is found online at http://www.dsd.state.md.us/PDF/CumulativeTable.pdf. This table lists the regulations in numerical order, by their COMAR number, followed by the citation to the Maryland Register in which the change occurred. The Maryland Register serves as a temporary supplement to COMAR, and the two publications must always be used together. A Research Guide for Maryland Regulations is available. CITIZEN PARTICIPATION IN
THE REGULATION-MAKING PROCESS

Maryland citizens and other interested persons may participate in the process by which administrative regulations are adopted, amended, or repealed, and may also initiate the process by which the validity and applicability of regulations is determined. Listed below are some of the ways in which citizens may participate (references are to State Government Article (SG),

Annotated Code of Maryland):

By submitting data or views on proposed regulations either orally or in writing, to the proposing agency (see Opportunity for Public Comment at the beginning of all regulations appearing in the Proposed Action on Regulations section of the Maryland Register). (See SG, 10-112)

By petitioning an agency to adopt, amend, or repeal regulations. The agency must respond to the petition. (See SG 10-123)

By petitioning an agency to issue a declaratory ruling with respect to how any regulation, order, or statute enforced by the agency applies. (SG, Title 10, Subtitle 3)

By petitioning the circuit court for a declaratory judgment

on the validity of a regulation when it appears that the regulation interferes with or impairs the legal rights or privileges of the petitioner. (SG, 10-125)

By inspecting a certified copy of any document filed with the Division of State Documents for publication in the Maryland Register. (See SG, 7-213)

The Maryland Department of Legislative Services receives copies of all publications issued by State officers and agencies. The Department prepares and distributes, for a fee, a list of these publications under the title Maryland Documents . This list is published monthly, and contains bibliographic information concerning regular and special reports, bulletins, serials, periodicals, catalogues, and a variety of other State publications. Emergency Regulations

Under State Government Article, 10-111(b), Annotated Code of Maryland, an agency may petition the Joint Committee on Administrative, Executive, and Legislative Review (AELR), asking that the usual procedures for adopting regulations be set aside because emergency conditions exist. If the Committee approves the request, the regulations are given emergency status. Emergency status means that the regulations become effective immediately, or at a later time specified by the Committee. After the Committee has granted emergency status, the regulations are published in the next available issue of the Maryland Register. The approval of emergency status may be subject to one or more conditions, including a time limit. During the time the emergency status is in effect, the agency may adopt the regulations through the usual promulgation process. If the agency chooses not to adopt the regulations, the emergency status expires when the time limit on the emergency regulations ends. 08.01.11 Coast Smart Council

.01 Scope.

A. This chapter applies to all units of State and local government that construct projects subject to the Coast Smart Construction Program.

B. This chapter does not apply to the reconstruction of a highway facility.

.02 Definitions.

A. In this chapter, the following terms have the meanings indicated.

B. Terms Defined.

(1) The following terms have the meaning stated in Natural Resources Article, 3-1001, Annotated Code of Maryland:

(a) Coast Smart ;

(b) Coast Smart Council ;

(c) Design criteria ;

(d) Siting criteria ;

(e) Structure ; and

(f) Substantial damage .

(2) Categorical Exemption means an exemption from the strict application of the Coast Smart siting or design criteria for a class of projects, provided the project has been designed to include adaptation and resiliency features to prevent or mitigate damage to the maximum extent practicable.

(3) Coast Smart Map means the map adopted by the Coast Smart Council delineating the boundary within which the Coast Smart Construction Program applies.

(4) Coast Smart Construction Program.

(a) Coast Smart Construction Program means the program that establishes Coast Smart siting and design criteria for the construction of new or reconstructed structures and new highway facilities within the boundary established by the Coast Smart Map.

(b) Coast Smart Construction Program includes the Coast Smart Map and the Coast Smart Construction Program Document, adopted by the Coast Smart Council

(5) Critical or Essential Facilities.

(a) Critical or essential facilities means buildings and other structures that are intended to remain operational in the event of extreme environmental impacts from flood, wind, snow, or earthquakes.[RT2] 

(b) Critical and essential facilities include hospitals, fire stations, police stations, storage of critical records, facilities that handle or store hazardous materials, drinking water and sewage treatment facilities, airports, transit and highway access and other essential transportation, and similar facilities.[RT3] 

(6) Emergency has the meaning stated in Public Safety Article, 14-101, Annotated Code of Maryland.

[R-4] (7) Historic structure means a structure that is located in the State and:

(a) Is listed in the National Register of Historic Places;

(b) Is designated as a historic property under local law and determined by the Director of the Maryland Historical Trust to be eligible for listing on the National Register of Historic Places; or

(c) Is:

(i) Located in a historic district listed on the National Register of Historic Places or in a local historic district that the Director of the Maryland Historical Trust determines is eligible for listing on the National Register of Historic Places; and

(ii) Certified by the Director of the Maryland Historical Trust as contributing to the significance of the district.

(8) Passive public access project means a project that:

(a) Provides either recreational or scenic access to water bodies or shoreline areas; and

(b) Requires location within a flood zone for its purpose.

(9) Qualifying agency means a unit of state or local government that funds, plans, designs, constructs, or oversees capital projects subject to the Coast Smart Construction Program. [S-5] [R-6] 

(10) Temporary structure means a structure intended to be in place for less than 180 consecutive days in any given calendar year.

(11) Water-dependent project means a project that by reason of its intrinsic nature or operation is:

(a) Dependent on the water;

(b) Requires location at or near the water[E-7] ; and

(c) Requires continued direct access to the water as an integral part of its use.

.03 Applicability.[RT8] 

A. A project shall comply with the Coast Smart Construction Program if it meets the criteria in B of this regulation.

B. The applicable Coast Smart Construction Program criteria are:

(1) The project is a capital project;

(2) The project is located within the Coast Smart boundary, as indicated on the Coast Smart Map;

(3) The project includes:

(a) The construction of a new structure;

(b) The reconstruction of a structure with substantial damage[RT9] ; or

(c) The construction of a new highway facility;

(4) At least 50 percent of the total project costs are funded with state funds; and

(5) The total project cost is $500,000 or more.

.04 Coast Smart Construction Program.

A. Projects subject to the Coast Smart Construction Program shall satisfy the Coast Smart siting and design criteria specified in [R-10] [R-11] the Coast Smart Construction Program Document published on the Department s [RT12] website.

B. For all projects subject to the Coast Smart Construction Program, the Qualifying Agency shall complete the Coast Smart Project Screening Form within the Coast Smart Construction Program Document.

.05 Categorical Exemptions.

A. The following categories of projects may be exempt from the strict application of the Coast Smart siting and design criteria:

(1) Water-dependent projects;

(2) Passive public access projects;

(3) Historic structures;

(4) Temporary structures; and

(5) Emergency projects.

B. A qualifying agency may determine that a project qualifies for a categorical exemption, provided that the qualifying agency demonstrates that the project has been designed to include adaptation and resiliency features to prevent or mitigate damage to the maximum extent practicable.

C. For all projects eligible for a categorical exemption, the qualifying agency must complete the Coast Smart Project Screening Form within the Coast Smart Construction Program Document and indicate the project category for which the exemption applies.

D. The qualifying agency may request input from the Coast Smart Council regarding the project s eligibility for and the qualifying agency s determination of an exemption.

E. The qualifying agency shall make the final determination as to whether a project qualifies for an exemption.

F. The qualifying agency shall provide the completed Coast Smart Project Screening Form to the Coast Smart Council upon request.[S-13] 

.06 Waivers.

A. A qualifying agency may request a waiver from one or more of the Coast Smart siting or design criteria.

B. The Governor's Sustainable Growth Subcabinet, established under State Government Article, 9-1403, Annotated Code of Maryland, shall review and decide waiver requests[R-14] .

C. The qualifying agency shall submit to the Governor's Sustainable Growth Subcabinet:

(1) The Coast Smart Criteria Waiver Form within the Coast Smart Construction Program Document;

(2) All necessary supporting documents including the Coast Smart Project Screening Form; and

(3) A letter:

(a) Identifying the specific siting or design criteria from which a waiver is requested;

(b) Justification for why the project is unable to meet the Coast Smart siting or design criteria; and

(c) Factors upon which the waiver request is based, as provided in the Coast Smart Construction Program Document.

.07 Reporting. [RT15] 

A. Upon request, a qualifying agency shall submit project information to the Coast Smart Council.

B. The information shall include the following list of projects:

(1) Projects that were located within the Coast Smart boundary, as indicated on the Coast Smart Map;

(2) Projects for which the qualifying agency made a categorical exemption determination; and

(3) Projects that received waiver determinations from the Governor's Sustainable Growth Subcabinet.

C. The qualifying agency shall maintain all project information, including the Coast Smart Screening Form, in accordance with the agency's document retention schedule.

TENTATIVE DETERMINATION TO RE-ISSUE PERMIT

General Discharge Permit for Animal Feeding Operations

 

The Maryland Department of the Environment (MDE) has made a tentative determination to renew, with modifications, the General Discharge Permit for Animal Feeding Operations, NPDES # MDG01, State Discharge Permit 25AF (25AF Permit).

 

The 25AF Permit is necessary to protect water quality and to comply with federal requirements under 40 Code of Federal Regulations (CFR) Parts 122, 123, 124, 125, and 412, as well as State requirements under Code of Maryland Regulations (COMAR) 26.08.04.09N. All concentrated animal feeding operations (CAFOs) in Maryland are required to have a discharge permit issued by MDE. Medium and large animal feeding operations (AFOs) are CAFOs if they discharge or propose to discharge to surface or ground water, or both, as defined in COMAR 26.08.03.09A. Any large AFO that does not otherwise qualify as a CAFO is a Maryland Animal Feeding Operation (MAFO) and must have a discharge permit issued by MDE. Other AFOs may be required to be covered under the 25AF permit at the discretion of MDE and the United States Environmental Protection Agency (EPA).

 

Existing CAFOs/MAFOs: All existing CAFOs and MAFOs that are currently registered under the 19AF General Discharge Permit (19AF Permit) requested continuing coverage under the 19AF Permit after its expiration. These requests were submitted on a Notice of Intent for Continued Coverage (NOICC) form. Once the NOICC was submitted to MDE, the expired 19AF Permit continued in full force and effect until the issuance of the 25AF Permit. To become registered under the 25AF permit, all existing CAFOs and MAFOs must pay any applicable fees, including any past due fees, and submit a current Required Plan within 30 calendar days upon request by MDE.

 

New Source CAFOs/MAFOs: Any person that wishes to operate a new source CAFO or MAFO in Maryland must be registered under the 25AF Permit before beginning the construction on any part of a new CAFO or MAFO. To become registered under the 25AF Permit, a person must submit to MDE an NOI, Required Plan, and the applicable permit application fee. Pursuant to 9-323(c) of the Environment Article, Annotated Code of Maryland, the Department may not issue a CAFO discharge permit to a person who begins construction on a new CAFO before obtaining permit coverage from MDE.

 

The proposed modifications to the 19AF Permit are listed below. The draft 25AF Permit is at least as stringent as the 19AF Permit. Most changes were editorial or clarified the 19AF Permit and were made to provide consistency and reflect current standards. Specific changes include:

a.        Table 2: Clarified that Cattle includes, heifers, steers, bulls, and cow/calf pairs and excludes mature dairy cows or veal calves

b.        Table 2: Clarified that Mature Dairy Cows can be milked or dry.

Part II

a.        Clarified in the AFO definition that if the animal is confined for any portion of the day, it is considered to be on the facility for a full day; the 45 days do not have to be consecutive; nor the same animals confined in any 12-month period

b.        Clarified process wastewater definition

c.        Added a definition for Site

Part III

a.        Added an email address for NOI submittals.

b.        Removed separate timeframe for implementation plan submittal and added it to the submittal as a part of the required plan.

Part IV

a.        Clarified that CAFOs need appropriate Air Quality permits before they can operate incinerators for mortality management.

b.        Added reference for pothole management.

c.        Added requirements for land application scenarios while winter restrictions are in place.

d.        Clarified that waterline inspections must also occur in between flocks.

e.        Expanded New Source Performance Design Criteria to all animal types.

f.         Added that permittees must notify the department of mailing address changes.

Part V

a.        Added an email address for noncompliance notifications.Part VII

a.        Updated continued coverage and permit renewal language.

b.        Updated and clarified transfer process.
