Register and COMAR
MARYLAND REGISTER
The Maryland Register is an official State publication published every
other week throughout the year. A cumulative index is published quarterly.
The Maryland Register is the temporary
supplement to the Code of Maryland Regulations. Any change to the text of
regulations published in COMAR, whether
by adoption, amendment, repeal, or emergency action, must first be published in
the Register.

CODE OF MARYLAND
REGULATIONS (COMAR)
COMAR is the official compilation of all regulations issued by agencies
of the State of Maryland. The Maryland Register is COMAR’s temporary
supplement, printing all changes to regulations as soon as they occur. At least
once annually, the changes to regulations printed in the Maryland Register are
incorporated into COMAR by means of permanent supplements.
CITATION TO COMAR
REGULATIONS
COMAR regulations are cited by title number, subtitle number, chapter
number, and regulation number. Example: COMAR 10.08.01.03 refers to Title 10,
Subtitle 08, Chapter 01, Regulation 03.
DOCUMENTS INCORPORATED
BY REFERENCE
Incorporation by reference is a legal device by which a document is made
part of COMAR simply by referring to it. While the text of an incorporated
document does not appear in COMAR, the provisions of the incorporated document
are as fully enforceable as any other COMAR regulation. Each regulation that
proposes to incorporate a document is identified in the Maryland Register by an
Editor’s Note. The Cumulative Table of COMAR Regulations Adopted, Amended or
Repealed, found online, also identifies each regulation incorporating a
document. Documents incorporated by reference are available for inspection in
various depository libraries located throughout the State and at the Division of State Documents. These depositories are
listed in the first issue of the Maryland Register published each year. For
further information, call 410-974-2486.
HOW TO RESEARCH REGULATIONS
An
Administrative History at the end of every COMAR chapter gives information
about past changes to regulations. To determine if there have been any
subsequent changes, check the ‘‘Cumulative Table of COMAR Regulations Adopted,
Amended, or Repealed’’ which is found online at http://www.dsd.state.md.us/PDF/CumulativeTable.pdf.
This table lists the regulations in numerical order, by their COMAR number,
followed by the citation to the Maryland Register in which the change occurred.
The Maryland Register serves as a temporary supplement to COMAR, and the two
publications must always be used together. A Research Guide for Maryland
Regulations is available. For further information, call 410-260-3876.

CITIZEN PARTICIPATION IN
THE REGULATION-MAKING PROCESS
Maryland citizens and other interested
persons may participate in the process by which administrative regulations are
adopted, amended, or repealed, and may also initiate the process by which the
validity and applicability of regulations is determined. Listed below are some
of the ways in which citizens may participate (references are to State
Government Article (SG),
Annotated
Code of Maryland):
• By submitting data or views on proposed
regulations either orally or in writing, to the proposing agency (see
‘‘Opportunity for Public Comment’’ at the beginning of all regulations
appearing in the Proposed Action on Regulations section of the Maryland
Register). (See SG, §10-112)
• By petitioning an agency to adopt, amend,
or repeal regulations. The agency must respond to the petition. (See SG
§10-123)
• By petitioning an agency to issue a
declaratory ruling with respect to how any regulation,
order, or statute enforced by the agency applies. (SG, Title 10, Subtitle 3)
• By petitioning the circuit court for a
declaratory judgment
on
the validity of a regulation when it appears that the regulation interferes
with or impairs the legal rights or privileges of the petitioner. (SG, §10-125)
• By inspecting a certified copy of any
document filed with the Division of State Documents for publication in the
Maryland Register. (See SG, §7-213)

Maryland Documents
The Maryland Department of
Legislative Services receives copies of all publications issued by State
officers and agencies. The Department prepares and distributes, for a fee, a
list of these publications under the title ‘‘Maryland Documents’’.
This list is published monthly, and contains bibliographic information
concerning regular and special reports, bulletins, serials, periodicals,
catalogues, and a variety of other State publications. ‘‘Maryland Documents’’
also includes local publications.

Standards of Conduct for Executive Branch Employees Use of Confidential Information and Prediction Markets
WHEREAS, On January 19, 2023, I issued my first Executive Order, 01.01.2023.01 - Standards of Conduct for Executive Branch Employees - which recognizes that those who enter public service in the State of Maryland do so as a public trust and have a duty to maintain the highest standards of integrity and honesty in government service;
WHEREAS, Section E of that Executive Order states that State "[e]mployees shall not engage in financial transactions using nonpublic government information or allow the improper use of such information to further any private interest";
WHEREAS, The citizens of Maryland deserve a government where State business is conducted truthfully and honestly, free from the existence or perception of any corruption or misconduct;
WHEREAS, Any unethical behavior on the part of any State employee must be promptly reported to the appropriate authorities for investigation;
WHEREAS The recent rise of "prediction markets," which allow individuals to bet on the occurrence specific outcomes, or gamble on real world events, for financial gain has opened the possibility that State employees can use knowledge obtained through their government service to enrich themselves personally;
WHEREAS, Several examples of individuals using nonpublic federal government information - including information regarding the timing of the United States' military's capture of former Venezuelan president Nicolas Maduro and information regarding military action in Iran - to benefit themselves personally through the use of prediction markets are reportedly being investigated by federal prosecutors for possible violations of insider trading laws; and,
WHEREAS Given the rise of prediction markets and the risk that these markets could be abused by those with access to nonpublic Government information for personal gain and thereby contribute to the deterioration of the public trust in State government.
NOW THEREFORE, I, WES MOORE, GOVERNOR OF THE STATE OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN ME BY THE CONSTITUTION AND LAWS OF MARYLAND, HEREBY PROCLAIM THE FOLLOWING EXECUTIVE ORDER, WHICH IS APPLICABLE TO MYSELF AND LIEUTENANT GOVERNOR ARUNA MILLER, AND IS EFFECTIVE IMMEDIATELY:
A. The term "State employees" includes all Executive Branch employees, including political appointees, members of boards and commissions, and contractors and subcontractors of the State.
B. State employees shall not engage in financial transactions, including transactions made on prediction markets, using nonpublic government information obtained through their State employment or contractual relationship with the State, to benefit themselves financially or to further any private interest.
C. All departments and agencies shall immediately refer to the Principal Counsel or Assistant Attorney General of the department or agency or to the Deputy Attorney General with supervisory responsibility over the department or agency, any instance of a possible violation of this Executive Order or other unethical behavior, for such action as the Office of the Attorney General deems appropriate. All departments and agencies shall also immediately advise the Chief Legal Counsel to the Governor of any such referrals. D. Consistent with all applicable substantive and procedural laws, violation of this Executive Order is grounds for employee disciplinary action, including and up to termination from State employment and termination of any contractual relationship.

The Secretary of Natural Resources proposes to amend Regulations .03 and .05
under COMAR 08.02.13 Fishing Licenses—Point Assignment, License Revocation

Statement of Purpose
The purpose of this action is to modify the Department’s commercial
and recreational penalty schedules based on the recommendations of the Sport
Fisheries Advisory Commission/Tidal Fisheries Advisory Commission Joint Penalty
Workgroup. In addition to the fines that violators face in District Court, the
Department maintains these administrative penalty schedules as a deterrent to
breaking fisheries laws.
Updates for the Recreational Schedule
(1) The action proposes to create a 1 year suspension for using illegal gear in catch-and-release trout fishing areas. The creation of a suspension for using illegal gear in catch-and-release trout areas is necessary to standardize the penalty for using prohibited gear in special management trout areas. There is already a 1 year suspension on the penalty schedule for using illegal gear in delayed harvest trout fishing areas, which are catch-and-release during part of the year and allow harvest during other parts of the year. The gear restrictions in delayed harvest trout fishing areas are only in place when the area is managed as catch-and-release. In contrast, catch-and-release trout fishing areas are managed year-round with more stringent gear requirements – either fly fishing-only or fly and artificial lure-only – due to the expectation that fish that are caught will be released, not retained. Standardizing the penalty for violating these more restrictive gear rules will ensure fairness in the way similar violations are treated.
(2) The action proposes to create a 1 year suspension for possession of trout in a delayed harvest trout fishing area when harvest is prohibited. Creating a suspension for possession of trout in a delayed harvest trout fishing area when possession is not allowed will mirror the current penalty for possession of trout in a catch-and-return trout fishing area. In both instances, harvest of trout is not allowed. These areas are managed as catch-and-release in order to provide additional angling opportunities in areas that support trout for a longer period of time than areas managed as put-and-take areas.
(3) The action proposes to create a 180 day suspension for individuals age 16 or older fishing on a designated youth trout fishing day in a put-and-take trout fishing area designated as Closure 1. This is the same penalty that currently exists for fishing in a closed area. Youth Trout Fishing Day is held the Saturday before Closure 1 put-and-take trout fishing areas open in order to provide additional, lower-pressure opportunities for children to experience fishing. Closure 1 runs from 10 p.m. the first Sunday after March 4 to 6:30 the last Saturday in March. The penalty schedule currently has a 180 day suspension in place for anyone fishing in Closure 1 areas during the rest of the closure. However, with the creation of Youth Trout Fishing Day in 2024, there is now a possibility of an adult being cited for “Fishing on Youth Trout Day” rather than “Fishing in a Closed Area”. The Department often allows for a period of time between when regulations change and when it institutes administrative penalties for violations of those regulations. At this point both the Penalty Workgroup and the Department believe it is time to ensure that adults fishing on Youth Trout Fishing Day face the same penalty as if they fished in a closed area the day before or the day after Youth Trout Fishing Day.
(4) The action proposes to create a 180 day suspension for harvest of freshwater mussels in tidal waters. This will mirror the current penalty for harvesting freshwater mussels in nontidal waters. The harvest of freshwater mussels in nontidal waters has been prohibited for many years and violators of that rule currently face a suspension of up to 180 days. Because the way the General Assembly has granted the Department authority to regulate species varies between tidal and nontidal waters, that prohibition did not exist in tidal waters until February 2025 when the Department declared freshwater mussels as a species in need of conservation and adopted regulations to prohibit the catching, possession, or sale of freshwater mussels caught in Maryland waters. Freshwater mussels do not commonly appear in most tidal systems in Maryland, however the Department is conducting restoration work in the tidal portion of the Susquehanna River below the Conowingo Dam. Due to these efforts, it is important to ensure that harvest of these species does not occur. The Penalty Workgroup and the Department believe that mirroring the penalty between tidal and nontidal waters is appropriate.
Updates for the Commercial Schedule
(1) The action proposes to create administrative penalties for violations of
male crab limits that mirror the penalties for violations of mature female
bushel limits. Those penalties are broken out both by license type and by
amount over the catch limit. The creation of administrative penalties for
violations of male crab limits is necessary because as the crab population
continues to experience a period of lower levels, there must be adequate
deterrence for violators to follow the rules. When the penalty schedule was
created, the Department did not have commercial male crab limits. When male
crab limits were initially created, the Department did not anticipate needing
to continue to use that management tool very frequently. Because this
management tool continues to be used, the Penalty Workgroup and the Department
believe it is necessary to add these penalties as a deterrent. Mirroring the
penalties for other crab catch limit violations was determined to be the fairest
path forward.
(2) The action proposes to include area violations by power dredges, sail dredges and sail dredges using an auxiliary yawl in the various current penalties for dredging in prohibited areas. These violations are all on the Tier III (15 point) level of the penalty schedule. It is necessary to include violations by power dredges, sail dredges and sail dredges using auxiliary yawls in each of the references for penalties that apply to dredging in prohibited areas because regardless of whether a vessel is powered by its own engine, by sail, or by an auxiliary yawl, dredges are limited to designated areas and potential penalties should be similar between the gear types.

The State Board of Education proposes to amend Regulations .03
and .08 under COMAR 13A.05.01 Provision of a Free Appropriate
Education. This action was
considered by the State Board of Education at their March 24, 2026 meeting.
Statement of Purpose
The purpose of this action is to prevent students from being determined as eligible for the alternate assessment until the IEP meeting immediate proceeding a student’s third grade year. Also, only students with the most significant cognitive disabilities are eligible for alternate assessment participation.

.07 Local School System Screening Procedures Evaluation.
A. Each county board of education shall provide an annual
attestation to the State Board of Education demonstrating that it has complied
with the requirements of this chapter.
B. By July 1, 2027, each local education agency shall perform a
limited review to ensure the policies and procedures established are compliant
with this chapter and are being consistently implemented.
(1) The limited review shall include an audit of employees hired
within a year of the review.
(2) The results of the review shall be submitted to the State
Board of Education.

The Interagency Commission on School Construction proposes to amend
Regulations .06 and .09 under COMAR 14.39.02 Administration of the Public School
Construction Program. This action was considered by the Interagency
Commission on School Construction at two separate open meetings, the first on July
17, 2025, to address several of the amendments, and then on March 12, 2026, to address
subsequent revisions to 14.39.02.06. Additionally, amendments to 14.39.02.09
were considered at the April 9, 2026, IAC Meeting. Notice of all meetings were
provided via publication on the General Assembly website pursuant to the
General Provisions Article, §3-302(c), Annotated Code of Maryland.
Statement of Purpose
The purpose of this action is to implement a Small County State Cost Share adjustment, establish State cost share amounts for each local education agency and the Maryland School for the Blind for FY 2027 and 2028, and to provide a 10-percentage-point State cost-share increase where the LEA is located in a Tier 1 county, and clarify under what circumstances State funding may be used for early site work as a portion of project development and design funding.

project is to maintain navigable access to an existing marina.
Description of Authorized
Work:
The work involves hydraulically dredging a 30,585 square foot area of
the entrance channel (approximately 2,000 cubic yards) to a depth of -7 feet
mean low water (MLW) elevation annually, installing a hydraulic hose
temporarily anchored to the bottom of the waterway between the dredge area and
the beach nourishment area, and hydraulically depositing the approximately
2,000 cubic yards of sand material as beach nourishment on the adjacent beach located
to the south of the Flag Harbor Marina on the Long Beach Civic Association
property over an area of approximately 29,600 square feet/0.68 acres with a
maximum extent of 82 feet waterward of mean high water (MHW). Additionally, the
work would include repairs an existing stone jetty by emplacing 300 square feet
(5-foot wide by 60-foot long) stone riprap on the beach landward of MHW to
support an existing segment of the jetty and emplacing 400 square feet (10-foot
wide by 40-foot long) stone riprap on top of an existing segment of jetty,
above MHW, to raise the elevation and prevent sand from transitioning to the
channel.

The purpose of this proposed work is to
provide public access to the waterfront, resiliency and protection from
erosion, while also enhancing aquatic habitats and improving water quality.
Description of Authorized Work:
1.
Remove of an
existing pier (pier 5) and dry dock.
2.
Construct
760 linear feet of a wood and gravel sand-containment structure to fill and
grade with 35,000 cubic yards of sand and gravel fill to establish 4,695 square
feet of low marsh, 1,705 square feet of high marsh, 4,775 square feet of
supratidal and riparian buffer plantings within a maximum of 50 feet
channelward of the existing mean high water line. The proposed marsh includes:
a.
Woody debris
features for both stability and habitat.
3.
Construct 80
linear feet of gravel shoreline for kayak access
extending a maximum of 35 feet channelward of the mean high
water line. The gravel shoreline includes:
a.
Planting
mounds,
b.
A 27.5-foot
long by 8.5-foot wide concrete paver access location,
c.
A 27.5-foot
long by 2-foot wide stone protection adjacent to the pavers.
4.
Repair and
upgrade three existing pier decks. The pier deck improvements include:
a.
Pier 1:
Repairs and new decking on a 33-foot by 29-foot existing concrete pier;
b.
Pier 2:
Repairs and new decking on a 33-foot by 33- foot existing concrete pier;
c.
Pier 3:
Repairs to the 78-foot by 35-foot by existing concrete
platform, a new 50-foot by 23.5-foot platform, and 12 supratidal planting areas
located in the open spaces within the concrete pier.
5.
Construct 30
linear feet that extends 15 feet channelward of the mean high water line.
